SURENA RUGS,
631 Miami Circle, Suite 30, (404) 812-1881, sells the merchandise covered by this invoice to the Buyer according to the following terms and conditions:
FINAL SALES:
All sales are final unless otherwise specifically stated on the front of this invoice an no oral agreement to the contrary is enforceable.
RULES FOR SALE ON APPROVAL:
If the front of this invoice states that the sale is a “Sale on Approval,” the merchandise must be returned in as good condition as it was received by the Buyer within the time specified on the front of the contract, or, in all cases no later than ten business days after the date of receipt of the merchandise by the Buyer, or the sale will become final, unless the customer notifies Surena Rugs by writing or orally extends the terms. On a “Sale on Approval,” the Buyer assumes all risk and liability for any damage, injury, or loss of any kind or nature to the merchandise, whether arising or resulting from fire, accident, water, theft, pilferage, vandalism, or any other risk or cause whatsoever while said merchandise is on approval. Buyer promises to hold Surena Rugs harmless for any such loss, risk, or liability, wherever such loss may occur after the approval period begins. Buyer’s responsibility for risk of loss shall commence upon release of the merchandise at Surena Rugs’ place of business. If the merchandise is returned within the approval period and is in as good condition as it was when delivered to Buyer, Surena Rugs agrees to refund the purchase price in full. IF THE MERCHANDISE IS DAMAGED IN ANY MANNER, THE SALE SHALL BE FINAL AND THE BUYER SHALL BE LIABLE TO SURENA RUGS FOR THE FULL PURCHASE PRICE and Surena Rugs may retain any deposits or payments it has received or that it holds. If, after taking such payments, the full purchase price has not been paid, then Buyer shall be liable for the balance of the purchase price outstanding.
LIMITED WARRANTY:
SURENA RUGS, A GEORGIA CORPORATION, WARRANTS AND GUARANTEES THAT THE MERCHANDISE SOLD IS GENUINE HANDMADE MERCHANDISE FITTING THE DESCRIPTION SET FORTH ON THE FACE OF THIS INVOICE. ALL MERCHANDISE SOLD PERSUANT TO THIS INVOICE IS SOLD WITHOUT ANY OTHER WARRANTY, EXPRESS OR IMPLIED. NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE IS MADE OR SHALL APPLY. LIABILITY FOR SPECIAL, INCIDENTAL, AND CONSEQUENTIAL DAMAGES ARE HEREBY FULLY DISCLAIMED AND EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW. SURENA RUGS SHALL NOT BE IN ANY CASE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, whether arising from breach of contract, negligence, breach of warranty, or any other legal theory.
Some states do not allow the exclusion or limitation of incidental or consequential damages, or apply to you. This Limited Warranty gives you specific legal rights, and you may also have rights which vary from state to state.
THIS LIMITED WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. All claims under this Limited Warranty must be made within 30 days of the purchase and directed in writing to Surena Rugs. The sole remedy under this limited warranty shall be a return of the purchase price in exchange for a return of the merchandise.
GEORGIA LAW:
This agreement shall be construed according to the laws of the State of Georgia.
SOLE AGREEMENT:
the agreement constitutes the sole agreement of the parties and may only be modified by a writing signed by all of the parties hereto.
All sizes are approximate.
All claims and returned goods MUST be accompanied by this bill.
